§ 1 Scope of Application

The following General Terms and Conditions apply to the business relationship between Carl Hanser Verlag GmbH & Co. KG (hereinafter referred to as the Seller) and the Customer.

§ 2 Ordering Process

You have the opportunity to browse our offerings at your leisure. If you find something interesting, you can place the product in your virtual shopping cart. To do this, click on the colored button labeled "Buch / E-Book in den Warenkorb" (Book / E-book to Cart), which we have displayed below the product. You have the option to remove products from your shopping cart at any time.

You initiate the ordering process by clicking on the “Warenkorb” (Shopping Cart) button, which is always available to you on the top right of the website. You will then receive an overview of all products you have placed in the shopping cart, as well as any shipping costs incurred in connection with your order. You have the option to remove products from the shopping cart again.

Before submitting your order via the "Zahlungspflichtig bestellen" (Place order subject to payment) button, you have the opportunity to review and correct your entries at every stage of the ordering process. To change the order quantity, overwrite the quantity in the corresponding field. To delete products, click the "Aus dem Warenkorb entfernen" (Remove from cart) button under "Einkaufswagen" (Shopping Cart).

Before an order is triggered, you must declare your agreement with these General Terms and Conditions (AGB) in the overview of your order. By pressing the "Zahlungspflichtig bestellen" button, your order is triggered and forwarded to us. With your order, you make a binding declaration of your intention to purchase the goods.

§ 3 Conclusion of contract

When placing an order, you enter into a contract with: Carl Hanser Verlag GmbH & Co. KG, Vilshofener Str. 10, 81679 Munich. You will be informed immediately of the receipt of your order by an email labeled “Order Confirmation,” which will include an overview of your order and these Terms and Conditions, including the statutory cancellation policy. The order confirmation does not yet constitute acceptance of your offer. Your order is accepted when we execute it, in the case of printed books when they are shipped, and in the case of e-books when the download link is provided by email. The language available for the conclusion of the contract is German.

§ 4 Reservation of non-availability

If an item is not available at the time of ordering, we will indicate this before you complete your order. If items are marked as “Currently unavailable,” they will not be available for delivery for an extended period of time. In this case, it will not be possible to order them in the online shop. You will receive a corresponding notification during the ordering process and will then have the option of removing the item from your shopping cart or canceling the order. If we indicate availability with “This book is currently being reprinted,” we are in the process of reprinting these items, which means they are temporarily unavailable. You will receive a corresponding notification during the ordering process. It usually takes five to ten business days for the books to be delivered from the printer and received back in the warehouse, after which your order will be processed immediately and at no additional cost. If you do not wish to have the items forwarded, you have the option of removing the title from your shopping cart during the ordering process. In the event that your order contains both items with the status “immediately available” and “this book is currently being reprinted,” we will fulfill the order in partial deliveries. This will not incur any additional costs for you. In the event that an item is permanently unavailable, we reserve the right to refrain from fulfilling your order and to withdraw from the contract. In this case, we will inform you immediately of the unavailability and refund any purchase price you may have already paid without delay.

§ 5 Prices

All prices are final prices in euros and include the statutory value added tax. Any delivery and shipping costs will be charged separately. The prices for books and e-books are fixed in Germany and Austria in accordance with the Price Fixing Act. We cannot rule out price deviations due to incorrect entries or data deliveries. In this case, the prices according to the price fixing act apply.

§ 6 Delivery

Printed works/books will be delivered to the address you provide. Digital works/e-books will be delivered by providing a download link to the email address you provide. The delivery of goods and the provision of digital works is carried out by our service partner, Verlegerdienst München GmbH, Gutenbergstraße 1, 82205 Gilching, Germany, tel. 0800 44 55 644 (toll-free), email: hansershop@verlegerdienst.de The delivery time for printed works/books is as follows: Germany: 2 to 4 business days Austria and Switzerland: 2 to 5 business days Other countries: 2 to 18 business days Digital works/e-books are usually delivered by sending an email with a download link to the email address you provided. As the customer, you are responsible for downloading the file. With your purchase, you receive the simple, non-transferable right to use the purchased e-books for your personal use only in accordance with copyright law. It is not permitted to modify or edit a file or parts thereof in any way or to make it available to third parties privately or commercially in any way. We deliver our digital products with a personal digital signature (“watermark”) that identifies the lawful use of the e-book exclusively by the individual customer.

§ 7 Shipping costs

Shipping costs for orders placed via the Hanser Fachbuch website at www.hanser-fachbuch.de: Shipping within Germany is free of charge. For deliveries to all other countries, shipping costs are calculated as follows:

Shipping costs for orders from the Hanser Literaturverlage website at https://www.hanser-literaturverlage.de: Shipping within Germany, to Austria, and to Switzerland is free of charge. For deliveries to all other countries in the European Economic Area (EEA), we charge shipping costs of €10.00. Outside the EEA, shipping costs of €20.00 apply.

§ 8 Import duties and taxes

Import duties and taxes may apply to deliveries outside the EU. These fees must be paid by the buyer. The publisher has no influence on these fees; please check with your local customs authorities.

§ 9 Payment

Payment for orders placed via the Hanser Fachbuch website at www.hanser-fachbuch.de: The purchase price is due immediately and payable without deduction. You can pay by invoice (up to €199.99 shopping cart), SEPA, credit card (Visa and Mastercard), or PayPal. E-books can be purchased via PayPal or credit card and NOT on account or SEPA. Purchases of e-books on account can only be made upon request to customer service support. Payment for orders from the Hanser Literaturverlage website at https://www.hanser-literaturverlage.de: You have various payment options, which depend on the billing address and the selected product type (book, e-book). The purchase price is due immediately and payable without deduction. Invoice: Payment by invoice is possible for books or if your order contains both a book and an e-book (mixed order) for billing addresses within Germany, Austria, Switzerland, and other countries in the European Economic Area (EEA). You can pay by transferring the amount to the bank account specified on the invoice. Credit card (Mastercard/Visa): We accept Mastercard and Visa credit cards. Payment is possible worldwide for books and e-books. PayPal: Payment via PayPal is possible worldwide for books and e-books.

§ 10 Right of withdrawal

Consumers have a statutory right of withdrawal and are entitled to receive information about their statutory right of withdrawal. We provide this information below in the form prescribed by law. Please note that when ordering an e-book, you agree to immediate performance of the service by providing a download link. This means that the service used is already provided by us upon conclusion of the contract and you therefore waive your statutory right of withdrawal.

CANCELLATION POLICY

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You can use the sample withdrawal form attached below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires. Consequences of revocation If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We will bear the costs of the return shipment within Germany if you return the goods using DHL and the “DHL Retour” return label. You can obtain the return label at http://bit.ly/retoure-hanser. For returns from abroad, the buyer bears the costs of the return shipment. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality.

§ 11 Retention of title

Until the purchase price has been paid in full by the customer, all delivered goods remain the property of the seller.

§ 12 Liability Warranty

The statutory liability for defects applies. We do not guarantee the availability of the website or access to digital products at all times. Rather, we would like to expressly point out that access to the website hanser-literaturverlage.de and the execution of download links for digital products may be temporarily unavailable or restricted due to maintenance work, security measures, or disruptions over which we have no control.

§ 13 Data protection

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR), the new Federal Data Protection Act (BDSG, as amended) and the Digital Services Act (DDG). § 14 Applicable law, place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the court responsible for our company headquarters in Munich. The contract is concluded upon confirmation of the order by the publisher.

The order can be canceled within 14 days by writing to Carl Hanser Verlag GmbH & Co. KG, Vilshofener Str. 10, 81679 Munich, Germany, by email, or by phone. To meet the deadline, it is sufficient to send a corresponding notification in good time.

The prices for a subscription consist of the price for the subscription and shipping costs and include the applicable statutory value added tax. The respective costs are listed individually.

In the case of subscriptions, the customer is obliged to purchase all further works published until at least the agreed termination date. The agreed minimum term or renewal period of the subscription is specified in the product information on the product page.

In compliance with the deadline specified on the product page, the subscription can be canceled for the first time on the cancellation date specified there, either in writing, by email, or by phone. After the cancellation date, the subscription can be canceled by the customer at any time without notice. Cancellation should be sent to the following contact address: kundencenter@hanser.de. The form provided at https://www.hanser-kundencenter.de/abo-kuendigen can also be used for cancellation. Value added tax is shown separately on the invoice.

The following applies to subscriptions that include free downloads from the online archives: The availability of the service is guaranteed within the scope of technical conditions and may be temporarily restricted due to necessary maintenance work. No claims for damages can be made due to a temporary failure of the online archive service.

General Terms of Use for Registered Users

Scope, Changes to the Terms of Use

Carl Hanser Verlag GmbH & Co.KG (hereinafter referred to as “Hanser”), Vilshofener Str. 10, 81679 Munich, represented by Carl Hanser Verlagsleitungsges. mbH, represented by managing directors Oliver Rohloff and Jo Lendle, offers you a range of services that require user registration in order to manage a personal area and download content. The following terms of use apply to this service.

Hanser reserves the right to change the terms of use with reasonable notice. Users will be notified of changes by email or when they log in. These changes are considered agreed upon if the user does not object within four weeks.

The following applies to subscriptions including free downloads from the online archives and offers for registered users: The availability of the service is guaranteed within the scope of technical conditions and may be temporarily limited due to necessary maintenance work. No claims for damages shall arise from a temporary failure of the online services.

Registration

When registering, the user undertakes to provide only truthful information and to keep this information up to date. The user can make updates themselves in their user account. If their email address becomes invalid, the user agreement expires and access to personal areas is no longer possible.

Subject matter of the service

The user is aware that content bearing a third-party company name or logo originates from that company and not from Hanser; Hanser merely grants access to this content. The same applies to contributions that are recognizable as originating from another user. Hanser is not responsible for this content. If the user believes that their rights are being infringed by such content, they have the option of notifying Hanser at kundencenter@hanser.de. If there is reasonable suspicion of a legal violation, Hanser will block the content and ask the author to comment. The user shall not abuse this right.

Rights of use

The user may only use the services provided for his own information purposes. To this end, he is permitted to store the information made available to him on his computer once, provided that Hanser offers the option of saving it. Any further reproduction, distribution, or use of the content is not permitted. In particular, the user is prohibited from passing on the content to third parties or using it for other purposes outside the scope of information, e.g. as part of their own offering. Furthermore, the user may not edit, modify, or translate the content offered, or remove copyright notices, for example. All rights remain reserved by Hanser or the respective copyright holder.

The user undertakes to respect the rights of third parties, including the rights of Hanser. The user is therefore expressly prohibited from:

  • using the content offered for advertising purposes without consulting the publisher;

  • sending or posting data which, due to its nature, quality, size or quantity, is likely to damage or block the operation of Hanser's computer center or data network or the computers of other third parties, or to spy on or damage the data contained therein (e.g. through viruses, Trojan horses, spam emails);

  • In connection with the use of www.hanser-kundencenter.de, to take actions or distribute content that infringes the rights of third parties (e.g., copyrights, trademark rights, personal rights) or violates applicable legal provisions, in particular applicable criminal laws, youth protection regulations, or competition law provisions. In particular, users are prohibited from distributing racist, violent, offensive, defamatory, or obscene content. “Distribution” also includes linking to such content; blocking/deleting content.

Indemnification by the user If Hanser is notified by a third party that content violates the rights of third parties or is otherwise illegal, Hanser is entitled to block this content. If the content in question was posted by the user, Hanser will immediately inform the user of the blocking and give them the opportunity to refute the allegations.

If Hanser is held liable by a third party, a court, or an authority due to culpable conduct on the part of the user, in particular due to a culpable breach of the obligations specified under “Rights of Use,” the user undertakes to indemnify Hanser against any claims and to bear the costs of legal defense. Hanser will inform the user immediately of any such claims. The user shall support Hanser in defending against these claims to the best of their ability. If the user fails to comply with this obligation within a reasonable period of time to be set by Hanser, Hanser shall be entitled to clarify the allegations of the third party at its own discretion, taking into account the factual and legal situation presenting itself to Hanser, and to contribute to reaching an agreement. The costs of settling the legal dispute shall be borne by the user, even if the settlement subsequently proves to be disadvantageous due to information not provided by the user.

Applicable law

The law of the Federal Republic of Germany applies.
